1. WARNING:
THE SERVICE PROVIDED BY MYSAFECAMPUS™ IS NOT AN EMERGENCY HOTLINE OR SUBSTITUTE FOR
CALLING EMERGENCY SERVICES, OR TAKING OTHER PRECAUTIONS TO SAFEGUARD ONE'S SAFETY, PERSONAL WELL-BEING OR PROPERTY. IN THE EVENT OF AN EMERGENCY OR OTHER SITUATION IN WHICH THE
USER FEELS THERE IS OR COULD BE A THREAT TO HIS/HER SAFETY, PERSONAL WELL-BEING,
OR TO PROPERTY, THE USER ACKNOWLEDGES THAT HE OR SHE IS TO IMMEDIATELY CALL EMERGENCY SERVICES
OR TAKE OTHER APPROPRIATE MEASURES TO PROTECT THEMSELVES, THOSE AROUND THEM, OR
ANY PROPERTY WHICH MAY BE IN DANGER OF HARM.
2. USER PRIVACY AND ANONYMITY
MySafeCampus™, pursuant to an agreement between it and User's institution,
has instituted a procedure whereby Users may report certain incidents concerning
his or her Institution to MySafeCampus™ and may do so in an anonymous fashion. Should
you submit a report via telephone or Internet from within your Institution or through
equipment provided by your Institution, MySafeCampus™ does not take any responsibility
for possible monitoring and/or tracking of information submitted. The types of incidents
which may be reported include those which relate to threats of violence, harassment,
discrimination, theft and other concerns about the User's educational environment.
MySafeCampus™ will receive this information and will prepare a report for the User's
Institution. The obligation of MySafeCampus™ extends only to receiving and reporting
information and the User acknowledges and agrees that MySafeCampus™ will take no
action to address the subject matter of any information reported through this system,
without further authorization and direction from the User's Institution, which may
or may not be given by the User's Institution. MySafeCampus™ respects the User's
right to privacy and any information that personally identifies the User. MySafeCampus™ will not knowingly disclose the User's contact information (name, phone number,
fax number or email) to anyone unless the User specifically authorizes disclosure
of that information through the MySafeCampus™ Web site. MySafeCampus™ may use any
contact information which the User supplies in order to ask the User follow up questions
on behalf of the Institution to whom a report may be submitted, and will maintain
the User's anonymity in that process, unless the User authorizes MySafeCampus™ to
release such information. MySafeCampus™ will not knowingly release nor sell the
User's contact information to any third parties without the User's prior permission.
3. NOTICE AND DISCLAIMER
The Institution providing this service to the User reserves the right to choose
how it will act, or not act, based upon the information provided to MySafeCampus™ or in a report from MySafeCampus™ to the Institution, unless otherwise required
by law. Furthermore, the Institution is not required to disclose its response or
actions pursuant to any information that may be provided or reported to it.
4. RELEASE
As a User of the MySafeCampus™ service, and by submitting a report to MySafeCampus™,
the User acknowledges that the sole obligation of MySafeCampus™ shall be to receive
and transmit information provided by Users in the report on an anonymous basis,
unless otherwise specified by the User, to the User's Institution or the Institution
to which the report pertains. The User, on behalf of himself or herself, his or
her heirs, successors, family members, agents and assigns, agrees to and does hereby
release MySafeCampus™ and its respective officers, directors, shareholders, employees,
successors, predecessors, agents and assigns (the "MSC Parties"), of and from, any
and all liability, claims, actions, causes of actions and damages which relate in
any way to the MSC Parties' or the Users' Institution's actions or failures to take
action as the result of having received, or been available to receive, information
relative to a report.
5. ACKNOWLEDGEMENT
THE USER FURTHER ACKNOWLEDGES THAT THE INTENTIONAL MISREPORTING OF INFORMATION OR
USE OF THIS SERVICE FOR ANY PURPOSE OTHER THAN THAT FOR WHICH IT IS INTENDED IS
PROHIBITED, AND THAT THE INTENTIONAL MISUSE OF THIS SERVICE MAY RESULT IN INVESTIGATON,
AND POSSIBLE CRIMINAL PROSECUTION AND/OR CIVIL LIABILITY FOR MONETARY OR OTHER DAMAGES.
